FUFORE EMIRATE STANDS AS COURT NULLIFIES LEGAL CHALLENGE.

The Adamawa State High Court has struck out a suit filed against the state government challenging the creation of the Fufore Emirate, ruling that the action was procedurally defective and incompetent.
Delivering judgment, Justice Musa Usman held that the matter could not proceed as the plaintiff failed to comply with the mandatory requirement of issuing a pre-action notice before approaching the court.
The judge declared that such failure was fatal to the case and deprived the court of the jurisdiction needed to decide on the matter.
Justice Usman further ruled that the litigant’s inability to follow due legal procedure rendered the suit unsustainable, stressing that courts are bound by law to decline jurisdiction where procedural requirements are not met.
The case had sought to challenge the legality of the state government’s decision to establish the Fufore Emirate, questioning whether due process was followed in its creation.
Reacting to the ruling, Barrister Leonard Nzadon, who appeared alongside other counsel representing the first, second, and fourth defendants, described the judgment as a reaffirmation of constitutional order and administrative diligence.
According to NZadon, the plaintiff failed to establish a prima facie case to demonstrate that Governor Ahmadu Umaru Fintiri and the Adamawa State House of Assembly did not comply with the statutory provisions governing the establishment of traditional institutions.
The ruling effectively upholds the creation of the Fufore Emirate, reinforcing the legal standing of the state government’s action unless properly challenged through the appropriate legal channels.
